Timeline

  1. Attorney Michael Clement's lawsuit filed to oppose the 2025 BTNF Nelson Drive project.

  2. Retained attorney Austin Dunlap.

  3. March 13: Received Articles of Incorporation as a Public Benefit Nonprofit Corporation "Nelson Neighborhood Conservation Coalition"

  4. Next steps on our lawsuit, which will join the first suit:

    • Obtain affidavits from Nelson Neighborhood families.

    • File the Motion to Intervene.

    • The Court will review and make a determination on our Motion. If we meet the requirements under the Federal Rules of Civil Procedure (24(A)(2), the judge must permit us as a matter of right.

    • Once filed, the opposing party has 14 days to respond to the Motion to Intervene.

    • The judge will make a determination whether to grant the Motion or deny the Motion.  Only upon his granting of our Motion to Intervene will we be officially "in the suit".
